Will the Supreme Court shut down President Trump’s sweeping tariff efforts?
That’s an important question on the minds of folks who follow these things in Washington, D.C.
Potentially, the Supreme Court could step in and say that the President’s tariff policies are an overreach of his constitutional powers, and shut down his efforts to enact tariffs on practically every nation around the world.
The White House has used the International Emergency Economic Powers Act to justify the President’s policies, saying that he has over-arching power to enact tariffs and other economic sanctions in times of crisis.
Ultimately, only the Supreme Court could step in and rule whether that’s a correct interpretation of the law in question.
Chances are, you have an instinctual opinion on whether it is or is not, and it might very well align with your political opinions on President Trump.
But a good rule of thumb in questions like these is to imagine the shoe on the other foot.
If you’re a Trump supporter, would you be equally sanguine if the next Democratic President were to make massive, unilateral changes to international trade policy citing, say, a climate crisis rather than a trade deficit emergency?
And if you think President Trump’s tariffs should be shut down, are you comfortable potentially limiting the next President’s ability to punish foreign nations that don’t follow U.S. human rights standards?
These questions are never simple. And I certainly don’t have the answers. But eventually, the Supreme Court has to give a ruling, and probably sooner rather than later.
The deeper we get into this tariff regime, the harder it will be to untangle if the Court decides to shut it down.
In other news, there’s a cool trade possibility setting up on one of the hottest stocks over the last year: Walmart (WMT).
I was scanning the markets with the Wave Indicator this morning, and noticed that it was flashing a “Call” signal on WMT.
The price target is right at $102.
WMT is trading at about $99.50 as I write this, so there might be a nice little opportunity on a move higher here.
